The Motorsport360 application (“Motorsport360”) made available on authorized third-party platforms and devices is owned and operated by Motorsport 360 App ABN 64369690468 (“M360”).
1. Privacy Policy
This page is used to inform visitors regarding Motorsport360’s policies with the collection, use, and disclosure of Personal Information if anyone decided to use this Service.
If you choose to use Motorsport360’s Service, then you agree to the collection and use of information in relation to this policy. The Personal Information that we collect is used for providing and improving the Service. Motorsport360 will not use or share your information with anyone except as described in this Privacy Policy.
The terms used in this Privacy Policy have the same meanings as in our Terms and Conditions, which is accessible at Motorsport360 unless otherwise defined in this Privacy Policy.
2. Data Privacy Policy (App)
Data protection and the private sphere of the users are very important to M360. The collecting and use of your personal data takes place exclusively within the framework of the statutory provisions of applicable data protection laws. With this data privacy policy, M360 is providing information concerning the processing of personal data in the mobile applications (hereinafter referred to jointly as “Motorsport360” or simply “app”).

4. Area of applicability
This data privacy policy applies to all content, functions and services on Motorsport360, even if these only contain seasonal, short term or event related services (for example Le Mans 24 Hour or special features) within the operating systems which are offered.
5. Processing of personal data
Personal data will be processed before and during the downloading and installation of the app and during handling with and without a registration.
Personal data is information relating to factual or personal relationships of a defined or definable natural person. Above all, this includes information which allows your identity to be traced, for example name, address or email address.
Statistical data which we collect during a visit to our app for example and which cannot be connected to you does not come under the definition of personal data. This is referred to as anonymous data.
For a better experience, while using our Service, Motorsport360 may require you to provide certain personally identifiable information. The information that Motorsport360 requests will be retained on your device and is not collected by us in any way.
The app uses third party services that may collect information used to identify you, this is covered under their privacy policies:
Processing when using the app without registration
You can use our app without registration. Should you use the basic functions of our app which do not require a registration, personal data is still processed however.
The Motorsport360 app provide the following basic functions:

Follow a favourite motorsport and the “following” of news, video and audio links

Provision of content (text and video) on the basis of these preferences (if selected)

Provision of app updates via push notifications
Due to the way the app functions, the brief saving of the IP address is technically necessary. The IP addresses are deleted or anonymised after the processing. In case of anonymisation, the IP addresses are changed in such a way that the affected person cannot be identified or can no longer be identified. On the basis of the anonymised IP address, a location search will be carried out. For reasons connected to data protection, this only takes place on the geographical level of the country from where the access is taking place. By means of this, it is not possible to trace the actual location or place of residence of a user.
The data in technical protocols (so-called log files) are evaluated by us in anonymised form in order to continually improve our app and make them more user friendly, as well as in order to find and correct errors more quickly.
6. Disclosure of personal data
In principle Motorsport360 does not pass your personal data on to third parties. The data collected by us is only passed on to third parties, if this is necessary to provide the technical functionality of the app or another legal basis for the disclosure of data exists. Personal data may only be used by our service providers in order to fulfil their tasks. These suppliers were carefully selected by us and engaged in writing. They are subject to our instructions and are regularly monitored by us. Other use of the information is not permitted and is not carried out by any of the service providers used by us.
Alongside the service providers listed separately in this data privacy policy, data may be disclosed to individual categories of recipients, ie to companies in order to support promotions and special campaigns, as well as to external advisors and enforcement authorities.
7. Storage of personal data
Data which is collected for payment processes for chargeable app is only saved by us for as long as it held to be necessary in order to fulfil contractual or legal obligations, ie until the expiry of the statutory limitation period for proof purposes for claims under civil law or due to statutory retention obligations. For proof purposes, we must retain data from payment processes for a further three years from the end of the year in which the business relationships end. Any claims are time-barred according to the regular statutory limitation period, at the earliest at this time.
Data which can be assigned to a device-specific number will be deleted at the latest after 5 years of inactivity.
8. Push notification
The app uses push notifications, which you can select, alter or fully deactivate yourself in the app at any time. Below, we will explain to you – in separate terms according to the mobile operating systems for which we offer the app – how the activation or deactivation of the push notifications work.
8.1 iOS
Open the application “settings” of iOS and select the menu point “notifications”. In the following menu, you can find an overview of the app which are installed on your device and which support push functions. Select the corresponding Motorsport360 app. You can activate or deactivate the push notifications as described here.
Inside the app, you can set your preferences and only receive push notifications relating to your selected topics. In order to do this, access the “More” screen then “SETTINGS” then proceed to the “Push Notifications” option. Here, you can find an overview of your push settings, such as race start, race end or news which you can individualise in detail (for example warning when a race is about start, etc.). Finally, you can select the push notification for various events. You can turn these on or off according to your personal preferences.
8.2 Android
Open the application “settings” in the Android operating system and select the menu point “notifications” under “sounds and notifications. In the following menu, you can find an overview of the app which is installed on your device and which support push functions. Select the Motorsport360 app. Here, you can activate or deactivate the push notifications. The names may differ slightly according to the Android version used.
In order to set your preferences for push notifications inside the app, access the “More” screen then “SETTINGS” then proceed to the “Push Notifications” option. Here, you can find an overview of your push settings, such as race start, race end or news which you can individualise in detail (for example warning when a race is about start, etc.). Finally, you can select the push notification for various events. You can turn these on or off according to your personal preferences.
9. Permissions
For certain functions, the app needs to be able to access certain services and data on your device. Depending on which mobile operating system you use, this may require your express agreement to the accessing. Below, we will explain to you – in separate terms according to the mobile operating systems for which we offer the app – what authorisations the app requests and for what these are necessary.
9.1iOS
Push notifications: Should you click OK in the request “Enable push notifications”, you are permitting the app to inform you of certain events and topics by means of push notification (for example a pole position scored by your favourite driver), even if the app is not currently open. The notifications can take place by means of sounds, reports and/or symbol letter (a picture of a number on the app icon). Further information concerning push notifications and your configuration options can be found under number 6a).
Background updating: This function enables the app to download data in the background and to update this, even if the app is not currently open or are not being actively used.
Mobile data: This function enables the app to download and update data outside of a WLAN network via mobile data connections (for example GSM, UMTS or LTE).
9.2Android
Apart from the standard entitlements for the operation of Android app (such as the receipt of internet access or the option of letting the device vibrate; also called “normal entitlements” by Google), we do not request any further entitlements.
Using data which is saved on an external storage device: This function allows the app to save content on the storage card of your device. This is necessary in order to be able to provide content, for example relating to your favourite team, even if no Internet connection is currently present. For this purpose, the app only uses it’s own saved content. Other data on the storage card is neither deleted, altered or read.
10. Cookies
Cookies are files with a small amount of data that are commonly used as anonymous unique identifiers. These are sent to your browser from the websites that you visit and are stored on your device's internal memory.
This Service does not use these "cookies" explicitly. However, the app may use third party code and libraries that use "cookies" to collect information and improve their services. You have the option to either accept or refuse these cookies and know when a cookie is being sent to your device. If you choose to refuse our cookies, you may not be able to use some portions of this Service.
11. Service Providers
Motorsport360 may employ third-party companies and individuals due to the following reasons:

Motorsport360 values your trust in providing us your Personal Information, thus we are striving to use commercially acceptable means of protecting it. But remember that no method of transmission over the internet, or method of electronic storage is 100% secure and reliable, and Motorsport360 cannot guarantee its absolute security.

This Service may contain links to other sites. If you click on a third-party link, you will be directed to that site. Note that these external sites are not operated by Motorsport360. Therefore, we strongly advise you to review the Privacy Policy of these websites. Motorsport360 has no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.
14Children's Privacy
These Services do not address anyone under the age of 13. Motorsport360 does not knowingly collect personally identifiable information from children under 13. In the case Motorsport360 discover that a child under 13 has provided us with personal information, we immediately delete this from our servers. If you are a parent or guardian and you are aware that your child has provided Motorsport360 with personal information, please contact us so that I will be able to do necessary actions.
15. Advertising
In order to showcase relevant advertisements to our users, we use various technologies. These procedures take place anonymously or on the basis of pseudonyms, however never in a directly personal way. Below, we explain these technologies and the providers used for this purpose in more detail.
Within the framework of advertising technologies, we collect and process the Apple advertising ID (IDFA) on iOS devices and the Google advertising ID on Android devices in order to provide personalised advertising and to be able to evaluate its use. The advertising IDs are unique but not personalised and non-permanent identification numbers for a specified end device which are provided by the operating systems.
Below, we will explain to you – in separate terms according to the mobile operating systems for which we offer the app – how the activation or deactivation of the advertising technologies work.
15.1iOS
Open the “Settings” application of iOS and choose the menu point “data protection” and then the sub-point “Advertising”. Activate the option “No ad tracking”, then we can only carry out limited measures, such as the determining the unique user or combating fraud. In the same menu, you reset the IDFA at any time (“Reset Ad ID”), then a new ID will be created which will not combined with the data which was previously collected.
15.2Android
Open the application “Google settings” and select the menu point “Adverts”. Activate the “Deactivate interest related advertising” option, in order to prevent the creation of profiles and the display of interest related advertising. In the same menu, you reset the Google advertising ID at any time (“Reset advertising ID”), then a new ID will be created which will not combined with the data which was previously collected.
16. Your rights
Should you so request, we will notify you whether and what data relating to you is saved by us. If the statutory requirements are in place, you also have the right to correction, restriction of the processing or deletion of the data. You also have the right to receive the data relating to you in a structured, up-to-date and machine readable format from us. In order to claim these rights, please get in touch via the contact information above. This also applies, if you wish to object to the processing of your data in accordance with this data privacy policy in full or in relation to individual measures.
Finally, you have the right to complain to the competent supervisory authority for data protection, if you believe that the processing of personal data relating to you breaches data protection laws. You can claim this right by contacting a supervisory authority in the member state of your place of residence, place of employment or the location of the alleged breach.
17. Changes to the data privacy policy
Motorsport360 may update our Privacy Policy from time to time and reserves the right to alter this data privacy policy. Thus, you are advised to review this page periodically for any changes. Motorsport360 will notify you of any changes by posting the new Privacy Policy on this page. These changes are effective immediately after they are posted on this page.
